A legislative aspirant of Delta All Progressive Congress (APC), Mr. Felix Morka has challenged the conduct of the APC primaries for the Delta State House of Assembly for Ika South Constituency seat which held in October 5, 2019.
The applicant in an originating motion filed at a Delta High Court sitting in Agbor Judicial Division is seeking nine reliefs.
Joined in the suit are Monday Alika, 1st defendant, All Progressive Congress, 2nd defendant and INEC,3rd defendant.
Morka, in suit AG/28/2018, is seeking among other reliefs a declaration that the 1st defendant was not properly selected or nominated candidate of the 2nd defendant to contest the election into membership of Delta State House of Assembly for Ika South Constituency seat….having failed to comply with provisions of section of section 87(4)(c) of the Electoral Act,2010 as amended and the All Progressives Congress and guidelines for the nomination of candidates for the 2019 general election.
A declaration that the applicant is the rightful aspirant who was duly selected or nominated as the candidate of the 2nd defendant to contest the election into membership of the Delta State House of Assembly for Ika South Constituency seat…. having satisfied all requirements of both the Electoral Act, 2010 as amended and the All Progressives Congress Party Constitution and Guidelines for nomination of candidates for the 2019 general election.
An order setting aside the purported submission of the name of the 1st defendant to the 3rd defendant by the 2nd defendant as the nominated candidate of the 2nd defendant to contest the election into membership of the Delta State House of Assembly for Ika South Constituency slated to hold in March 2019.

The grounds for application are: the applicant is a member of the 2nd defendant party and participated as an aspirant in the primary election conducted by the 2nd defendant on Friday,5th October 2018 for the purpose of selecting or nominating a candidate to contest election on the platform of the 2nd into the elective office of member of the Delta State House of Assembly to represent Ika South Constituency.
The applicant emerged the winner of the said primary election by affirmation of majority of the delegates of the 2nd defendant and was so declared by the returning officer, Oghemeruemu Sylvester Imonina(the publicity secretary of the 2nd defendant in Delta State), and the result was ratified by the Electoral panel and published by the 2nd defendant.
The submission by the 2nd defendant of the 1st defendant’s name to the 3rd defendant as the candidate of the 2nd defendant to contest the forthcoming Delta State House of Assembly election into Ika South Constituency seat is wrongful and in violation of the provisions of Electoral Act 2010,as amended and the All Progressives Congress party Constitution and Guidelines for the nomination of candidates for the 2019 general election.
